TERMS AND CONDITIONS FOR USE OF EXHIBIT SPACE
Exhibitor Covenants:
The Exhibitor agrees to abide by all rules and regulations of LifeTime Expos & Events, (Producer), and agrees that Producer shall have the final decision in adopting any rule or regulation deemed necessary prior to, during and after the show. Exhibitors are required to have any and all business licenses, permits and health permits (if applicable) that are needed for its operation.
Exhibit Space:
The Exhibitor/Sponsor agrees to occupy exhibit space as assigned and to be open and staffed during all regular show hours. In the event the Exhibitor shall not occupy said space; the Producer is expressly authorized to occupy or cause said space to be occupied in such manner as it may deem best for the interest of the show without any rebates or allowance whatsoever to Exhibitor, and without in any way releasing the Exhibitor from any liability thereunder. Demonstrations must be confined to Exhibitor booth space and may not inflict excessive noise or discomfort to neighboring exhibitors. All aisles must be kept clear. No food products or beverages may be distributed from Exhibitor’s space without the approval of the Producer. All exhibits must be designed, constructed and operated in good taste and in accordance with the best interest of the exposition, which Producer, in its sole discretion shall have the right to decide. All sales, publicity and promotion activities conducted by the Exhibitor must be confined to this space unless authorized by the Producer.
Transfer or Subleasing Space Provided:
Exhibitor shall neither assign or sublet all or any part of the space rented without the permission of Show Management, and it shall be under no obligation to grant such permission.
Liability and Insurance Waiver:
LifeTime Expos & Events is not an insurer of Exhibitor’s business performance, success, attendance levels or Exhibitor’s property. If desired, Exhibitor may carry insurance, covering trade shows and fairs, which insures their goods and exhibits against loss liability and damage. Furthermore, the Exhibitor accepts all risks associated with use of the exhibit space and environs. The Exhibitor shall not make any claim or demand or take any legal action, whatsoever, against the Producer or the Exhibition Hall, or Sponsors in which the show is held for any loss, damage or injury howsoever caused, to the Exhibitor, its officers, employees, agents or their property. All of the Exhibitor’s property at the show shall be at the sole risk of the Exhibitor and the Producer assumes no responsibility for loss or damage thereto. All pertinent fire codes, laws, ordinances and regulations pertaining to health, fire prevention and public safety shall be strictly obeyed. All necessary measure for protection of the building equipment and furniture shall be at the expense of the Exhibitor. Exhibitors are responsible for damage they cause to the facility walls, ceiling and floors, including labor charges to remove stains or adhesives. Exhibitors will be billed for such damage with the dollar amount determined by the facility.
Display Characteristics:
Facility lighting may not illuminate all areas evenly and effectively, and Management assumes no responsibility for providing additional lighting. If available, an exhibitor may order additional lighting, at its own expense. All booth arrangements shall conform in all respects to the dimensional and height requirements as indicated.
Prizes, Lotteries and Raffles:
Drawings or contests of an appropriate and audited nature are allowed, providing no money changes hands. Winners of all contests must be selected at the show and winners names given to Show Management.
Cancellation Policy:
Cancellations received six months prior to the show date will be refunded in full. Cancellations received between three and six months prior to the show date will be refunded 50% of the payment received. Cancellations received at any time during the three months prior to the show date will receive no refund.
Move-In & Set Up:
Exhibitors will be admitted to the Facility on the morning of the expo from 9:00 am until 10:30 am. Exhibits must be dismantled after 3:00 pm that same day. Failure to setup within specified move-in times will result in forfeiture of exhibit space and all monies paid to date. Exhibit space can be reassigned at Show Management's discretion.
Cancellation or Curtailment of the Show:
In the event of earthquake, fire, flood, explosion, epidemic, lightning, terrorist acts, or Acts of God: or if the ground or building in which the show is held is destroyed or if for any reason the Producer is unable to permit the Exhibitor to occupy the space, or if the show is cancelled or curtailed, Producer will not have any liability to the Exhibitor for any loss of business, damage, or expense of any kind that the Exhibitor may suffer nor will any fees be refunded for space rental paid by Exhibitor/sponsor. If Producer is unable to hold the event due to circumstances beyond their control, the Producer will not be responsible for refunding fees paid or for any claims or damage which might arise inconsequence thereof by Exhibitor/Sponsor.
Disclaimer of Responsibility:
To the extent that Show Management does not have control over parking, food concessions, loading and unloading areas, or any and all other facilities and services used in, at, or in conjunction with the show, Show Management expressly disclaims responsibility for any aspect thereof. Show Management shall, to the best of its ability, serve as the liaison between the exhibitor and any such third party. Exhibitor agrees not to deal directly with any such third party without first obtaining the agreement of Show Management.
Complete Agreement:
This agreement contains all the terms and conditions agreed on by the parties hereto, and no other agreement, oral or otherwise, regarding the subject matter of this contract shall be deemed to exist or to bind any of the parties hereto.
